Pestcontrolchemicals.co.za (“the Company”) is a wholesale distributor and retailer of pest control products. By purchasing from or using this website, the customer agrees to the terms set out below.
1. Product Use and Responsibility

The customer acknowledges that they are solely responsible for the safe, lawful, and proper handling, storage, application, and disposal of any products purchased. The Company shall not be held liable for any misuse, incorrect application, negligence, or failure to follow label instructions.
2. No Warranties or Guarantees
The Company makes no representations or warranties, whether express or implied, regarding the safety, effectiveness, merchantability, or fitness for a particular purpose of any product sold. All such warranties, if any, are provided solely by the product manufacturer.
3. Limitation of Liability

5. Legal Compliance
In accordance with South African law, pesticide labels are legally binding documents. The customer agrees to read and strictly adhere to all label instructions, warnings, and safety precautions prior to use.
6. Customer Acknowledgement
By purchasing from the Company, the customer confirms that they:
• Are legally permitted to purchase and use pest control products
• Are capable of understanding product labels and safety instructions (in English)
• Accept full responsibility and risk associated with the use of such products
7. Returns, Refunds and Exchanges
Due to the nature of pest control and chemical products, the Company does not accept returns or exchanges on any products once sold, particularly where products have been opened, used, or tampered with. Returns will only be considered in the following circumstances:
• The product is defective, damaged, or not as described
• The incorrect product was supplied by the Company Any approved return must be in its original, sealed, and resalable condition (where applicable) and reported within 48 hours of delivery. Refunds, replacements, or credits will be processed at the Company’s discretion in accordance with applicable consumer protection laws. Delivery, handling, and administrative costs are non-refundable.
8. Delivery and Risk
All deliveries are carried out via third-party courier services. While the Company takes reasonable care in packaging and dispatch, the risk in the goods passes to the customer upon delivery. The Company shall not be held liable for delays, damages, or losses caused by third-party couriers, although reasonable assistance will be provided to resolve such issues.
9. Right to Refuse Sale
The Company reserves the right, at its sole discretion, to refuse or cancel any order if it believes that the sale may pose a risk to the customer, third parties, or the environment, or if the purchase appears unlawful or inappropriate.
10. Indemnity
The customer agrees to indemnify and hold harmless the Company, its directors, employees, and agents from any claims, damages, losses, liabilities, or expenses arising out of the purchase, use, misuse, or handling of any products.

The Company is committed to protecting customer personal information in accordance with applicable data protection laws. Customer information collected will only be used for order processing, delivery, and communication purposes, and will not be shared with third parties except where necessary to fulfil an order or where required by law.
